EEOC Issues ADEA Medicare Rule
The EEOC has issued a rule allowing an exception to the Age Discrimination in Employment Act (ADEA) that permits employer-sponsored retiree health benefits to be changed, reduced or eliminated when the employee becomes eligible for Medicare or comparable state programs.
The new rule is widely supported by employer, union and benefits groups but has been criticized by the AARP, which contends that it will lead to discrimination against older workers.
The new rule becomes effective on December 26.
