Question of the Week
At last week’s webinar, we let the audience select the topic of our July 30 webinar. The winner: Every Employment Law in 60 Minutes or Less.
To help make sure we spend our time together wisely, we thought we’d ask this question:
With which employment law do you struggle the most?
As always, thanks for your participation!

This is a very good question. Is it the law I have the least experience with? The law I “run into” the most? The law I “fear” the most because of its complexity? The law I would have to look up in order to remember anything about it?
Hmmm. I think I’ll answer all of those questions. Why? Because it’s a quarter to 11pm on a Tuesday night and I’m unemployed!
The law, out of the above choices, I have the least experience with is a tie between WARN and NLRA.
The law I “run into” the most is FLSA and FMLA.
The law I “fear” the most because of its complexity is probably when ADA, FMLA, state leave and injured worker laws collide.
The law I would have to look up to remember anything about it is ERISA. I mean, I know what it is about but I don’t remember a ton of details!

Thanks for your thoughts — great answer. I used the word “struggle” intentionally to try and capture a mixture of the things you mentioned. Your answer is dead-on with what I hear from lots of folks, especially on the interplay between ADA, FMLA and WC law, as well as the galactic complexity of ERISA. I have a lot of empathy for folks who struggle a bit with employment law. I can still remember the day many moons ago when I sat down and confronted the alphabet soup of acronyms for the first time. I almost quit on the spot. If I can figure ‘em out, anyone can!
