Supreme Court to Hear Key Employment Cases

The U.S. Supreme Court begins its next term on Monday.  Several employment law cases are on the docket.

Here are the questions the court will address . . .

Retaliation:  Does Title VII’s retaliation prohibition cover employees who participate in an internal investigation?

Arbitration:  Can employees ignore collective bargaining agreement provisions that require arbitration of age discrimination claims and go straight to court instead?

First Amendment:  Do state statutes banning government employers from making payroll deductions for political activities violate the First Amendment rights of unions and their members?

Benefits:  Under ERISA, is a qualified domestic relations order (QDRO) the only way a divorcing spouse may waive rights to his/her spouse’s pension benefits?
